On 26 June 2017 the Government,UK Visas and Immigration, published a policy document outlining how EU citizens and their family members living in or travelling to the UK will be treated once the UK leaves the EU.
In short, all EU nationals are going to have to apply for a residence document that proves their right to reside in the UK which will be granted under the UK’s own immigration rules.
Those living in the UK for at least 5 years and who do not pose any undue risk will be entitled to apply for settled status.
Those who have not been in the UK for the required 5 years by the cut-off date, which has not yet been decided on, will need to apply for a temporary residence document. These individuals can then apply for settled status once they have reached 5 years.
Those who arrive after the cut-off date will be able to apply for permission to remain after the UK leaves the EU. The cut-off date will be no later than the date the UK leaves the EU and no earlier than 29 March 2017.
EU nationals, including their family members who have permanent residence already issued under the EEA Regulations will still need to make an application under the new rules however the government are suggesting that the process required for these individuals will be a straight forward one.
It is claimed that the online system to be used for the application process will be up and running in 2018.
